This website provides information and a way to request a free introductory call. It does not accept payment or conclude a paid service contract online.

Trader

Services are supplied by Krzysztof Chwalek, a UK sole trader trading as Chwalek Agency.

Third Floor, 3 Hill Street
New Town
Edinburgh EH2 3JP
United Kingdom

The trader is not currently VAT registered. No company registration number applies.

Scope and contract formation

The website presents marketing consultancy and delivery services exclusively to businesses. A free introductory call does not itself create a paid contract. A contract is formed only when the parties agree a written proposal or order that identifies the service, scope, price, timing and applicable terms.

After an introductory call, any proposed work will be described in a written proposal. No paid contract exists until both parties accept a written document identifying the service, scope, price, timing and applicable terms. The accepted proposal takes priority where it expressly differs from these general terms.

Services and delivery

The precise deliverables, responsibilities, dependencies, timetable and acceptance criteria will be stated in the agreed proposal. Marketing outcomes are not guaranteed.

Delivery dates, revision limits, client responsibilities, required access and assets, subcontracting, intellectual-property arrangements, third-party platforms and advertising spend will be defined in the written proposal where relevant.

Prices and payment

The total price, currency, included costs and payment schedule must be given before an order is binding. The trader is not currently VAT registered, so VAT is not presently added.

Currency, payment method, deposits, invoice schedule, late-payment terms, expenses, media and tool costs, and any commission calculation will be stated in the written proposal. A VAT-status change will be communicated before it affects a price.

Changes, cancellation and termination

Project-specific rules for rescheduling, scope changes, client delay, suspension, termination, payment consequences and handover will be included in the written proposal or service agreement.

Liability and governing law

The proposal or service agreement will set out the liability limits, exclusions, indemnities, force majeure provisions, governing law and jurisdiction that apply to the engagement.
